What is Professional Liability Insurance (PLI)?

Also sometimes called malpractice insurance, Professional Liability Insurance (PLI) is an insurance policy that covers individuals who provide professional services, such as physical therapists and physical therapist assistants. The coverage offers protection from losses they may result after being held responsible for the losses of their patients/clients. This could be as a result of claims of malpractice, error, or mistake committed or alleged to have been committed by the PT or PTA in his/her professional capacity. 

Professional liability insurance is one form of protection for professionals and for their patients/clients. PLI shields your personal assets and will help you maintain a good reputation through the defense of allegations of wrongdoing which might be frivolous or false. For the patient/client who has damages through the actions of a professional, liability insurance will ensure that there are adequate funds available to make amends for the wrong that has been done. A professional liability policy typically covers errors, omissions or negligent acts, resulting from the normal or usual duties carried out by the insured person. When the professional is an employee, the employer is responsible for the actions of the employee. However, a court of law may find a professional personally responsible for an incident that occurred due to an error, omission or negligent act committed by the professional as an individual. 

Is PLI required in Illinois?

The Illinois Practice Act does not mandate that PTs and PTAs obtain PLI. However, certain employers may require that individual PTs and PTAs maintain PLI. You should consult your attorney or legal advisor on these issues. Please also consult the APTA resources for managing your risk to obtain more information on PLI.
