2019 General Assembly: Professions Seek Regulatory Licensure, Sunrise Legislation and Sunset Review

HB 2338 and SB 1220 propose to amend the Medical Practice Act of 1987 to provides for the licensure of naturopathic physicians.  SB 1198 proposes to create the Music Therapy Licensing and Practice Act, which would provide for licensure of music therapists by the Department of Financial and Professional Regulation.  HB 2710 would establish licensure for behavior analysts and assistant behavior analysts.

SB 1286 and SB 1756 propose to create the Regulatory Sunrise Review Act, which would establish a system to investigate and review the necessity of new State regulation over a previously unregulated profession or occupation. The IPTA supports this bill because it would provide a process to investigate what level of regulation – if any - is necessary in order to protect the health, safety, or welfare of the public.  If this were enacted, professions such as the naturopathic physicians, music therapists and behavior analysts would be subject to this process in order to pursue regulatory licensure.

SB 1840 would require the Department of Financial and Professional Regulation to conduct a survey of persons licensed or registered, or both, under a regulatory Act subject to be repealed under the Regulatory Sunset Act and to compile the results of that survey in a report that the Department must submit to the Governor and the General Assembly at least 12 months before the scheduled repeal of the regulatory Act. The survey would include questions concerning the licensees' or registrants' views on: how the requirements of the Act help to protect the health and safety of Illinois citizens; how the Act protects the profession from bad actors; what suggested changes to the regulatory Act would improve the profession; and how effective the continuing education requirements are.
